Comelec’s 2nd division ruled on the petition filed by lawyer Estrella Elamparo who sought to cancel Poe’s COC on the basis of the residency requirements for presidential candidates.

According to Elamparo, Poe failed to meet the 10-year residency requirement mandated by the Constitution for a presidential candidate.

In a press conference on Tuesday night, Poe spokesperson Valenzuela City Mayor Rex Gatchalian, Poe will appeal the decision before the Comelec en banc, “We will exhaust all legal remedies,” he said.

In the meantime, Poe continues to be a candidate, he added.
